# Terms of Service

These Terms of Service (**"Terms"**) govern your use of `obd2.online` and related services (the **"Service"**). By creating an account or using the Service you agree to these Terms.
## 1. What the Platform Is — and Is Not
The Platform is a **marketplace** that introduces clients (vehicle owners) to independent third-party automotive electricians (**"Electricians"**). We are **not** the provider of automotive services and we do **not** employ Electricians. Electricians are independent contractors solely responsible for the services they offer and perform.
We provide the technology to discover, communicate with, and pay Electricians. We do not warrant the quality, legality, or fitness for purpose of any Electrician's work. Always seek a licensed professional for safety-critical work.
## 2. Eligibility
You must be at least 18 years old and able to form a binding contract under your local law. The Service is not directed at children. We do not knowingly collect personal data from anyone under 16 (under 13 in the United States).
## 3. Account & Verification
You must provide accurate information. Electricians offering paid services may be required to complete identity verification (KYC) and, for premium tiers, license or certification verification. We may suspend or terminate accounts that fail verification or that we reasonably suspect of fraud or abuse.
## 4. Acceptable Use
Your use of the Service is subject to our [Acceptable Use Policy](./aup.en.md), incorporated by reference. The AUP **prohibits**, among other things, services that involve emissions defeat, odometer manipulation, VIN tampering, speed-limiter removal on commercial vehicles, or any activity unlawful in your jurisdiction.
Violations may result in immediate suspension, termination, forfeiture of held funds, and reporting to relevant authorities (e.g. EPA, EU type-approval authorities, transport regulators).
## 5. AI Features
We offer AI-assisted features (vision diagnostics, voice agent). When you interact with an AI feature, we will disclose this clearly. AI output is informational only, may be inaccurate, and **does not replace professional inspection**. We do not warrant AI output. Use of AI features is subject to fair-use limits and may require a paid subscription.
## 6. Recordings
Live sessions may be recorded only where both parties have explicitly consented in advance through the in-product consent flow. Recordings are stored encrypted and used only for safety, dispute resolution, and quality. We comply with two-party consent laws in applicable U.S. states (CA, FL, IL, MA, MD, MT, NH, NV, PA, WA, CT) and Article 6 GDPR for users in the EEA.
## 7. Payments, Subscriptions, Escrow
Payments are processed by Stripe. By providing payment information you authorize us and Stripe to charge you for the products and services you select.
**Subscriptions** auto-renew until cancelled. EU/UK consumers may cancel a paid subscription within **14 days** of purchase under Directive 2011/83/EU; this right does not apply once digital services have been substantially used with your prior consent. Cancellations take effect at the end of the current billing period unless required by law to be immediate.
**Service fees** are charged when a session begins or, for booked work, held in escrow until the work is confirmed completed (or 72 hours after session end without dispute, whichever is earlier).
## 8. Reviews
Only clients who completed a paid session may submit a review for that Electrician. Reviews must be the reviewer's honest opinion based on actual experience. Fake, paid, incentivized, or coerced reviews are prohibited. We do not edit or suppress legitimate negative reviews. Electricians may post one public response per review.
## 9. Content & Communications
You retain ownership of content you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and (for safety/moderation) inspect your content as necessary to operate the Service.
Messages you exchange in the Service are encrypted at rest. We do **not** monitor messages in real time, but automated systems may flag content matching narrowly defined patterns (e.g. references to forbidden services). Flagged content is reviewed by trained personnel only when necessary.
## 10. Notice and Action (DSA)
If you become aware of illegal content or activity on the Service, please notify us via the in-product **Report** function or by emailing `abuse@obd2.online`. We will acknowledge within 24 hours and act on substantiated notices within 7 days. EU users retain the right to refer disputes to certified out-of-court dispute settlement bodies under Article 21 of the Digital Services Act.
## 11. Ranking Transparency (P2B / DSA)
Electricians presented to clients are ranked by a composite score that considers: online status; subscription tier; rating and rating count; specialization match; brand match; vehicle year match; language overlap; distance (for on-site work); historical response time; current workload. ## 12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant the work, advice, or conduct of any Electrician. We do not warrant that AI output is correct.
## 13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED USD ($100). WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Nothing in these Terms limits liability that cannot be limited under applicable law (including death, personal injury caused by negligence, or fraud).
## 14. Indemnification
You will indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from (a) your use of the Service in breach of these Terms or applicable law, (b) any service you provide or receive through the Service, or (c) your content.
## 15. Termination
You may terminate your account at any time. We may suspend or terminate access for violation of these Terms or the AUP, suspected fraud, or where required by law. On termination, sections that by nature should survive (intellectual property, indemnity, liability, dispute resolution) will survive.
## 16. Changes
We may update these Terms. Material changes will be notified at least 30 days in advance by email and in-product. Continued use after the effective date constitutes acceptance.
## 17. Governing Law & Disputes
These Terms are governed by the laws of Estonia, without regard to conflicts-of-law principles. EU consumers retain the protections of mandatory law in their country of residence. Disputes will be resolved by the competent courts of Tallinn, Estonia, except where consumers may bring or be sued in their country of residence under applicable law. EU consumers may also use the European Commission's ODR platform: https://ec.europa.eu/consumers/odr.
